Digital Millennium Copyright Act (DMCA) Policy

Proghub.net ("we," "our," or "us") is committed to complying with U.S. copyright law and expects the same from our users. Our policy is to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA).

1. Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible through our service, please notify our copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
  2. Identification of the copyrighted work that you claim has been infringed;
  3. Identification of the material that is claimed to be infringing and where it is located on our service;
  4. Information reasonably sufficient to permit us to contact you, such as your address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and
  6. A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability.

2. Counter-Notification

If you believe that your material has been removed by mistake or misidentification, you may file a counter-notification with us (a "Counter-Notice") by submitting written notification to our copyright agent. Pursuant to the DMCA, the Counter-Notice must include substantially the following:

  1. Your physical or electronic signature;
  2. An identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access disabled;
  3. Adequate information by which we can contact you (including your name, postal address, telephone number, and, if available, email address);
  4. A statement under penalty of perjury by you that you have a good faith belief that the material identified above was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled; and
  5. A statement that you will consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you reside outside the United States for any judicial district in which the service may be found) and that you will accept service from the person (or an agent of that person) who provided the complaint regarding the alleged infringement.

After we receive your Counter-Notice, we will forward it to the party who submitted the original claim of copyright infringement. Please note that when we forward the Counter-Notice, it includes your personal information. By submitting a counter-notification, you consent to having your information revealed in this way.

If the original claimant does not file an action seeking a court order against you within ten (10) business days of receiving the copy of your Counter-Notice, we may restore the removed material. Until that time, your material will remain removed.

3. Repeat Infringers

It is our policy in appropriate circumstances to disable and/or terminate the accounts of users who are repeat infringers.

4. Modifications to Policy

We reserve the right to modify the contents of this policy at any time. You should review this policy frequently. Changes to this policy will be effective immediately after they are posted on this website. If we make any material changes to this policy, we will notify you by email (sent to the email address specified in your account) or by means of a notice on this website prior to the change becoming effective.
